Terms of Service
Please read these terms before you use ZangCash Pay.
1. Who we are and what these terms cover
ZangCash Pay is operated by ZangCash Pay Ltd, Nairobi Garage, Westlands, Nairobi, Kenya, referred to as “ZangCash”, “we” or “us”. These terms apply when you use our website at zangcash.com, our customer, business and agent portals, and any related services (the “Service”). By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. What ZangCash does, and does not do
ZangCash is a marketplace. Customers send requests for products and services. Verified businesses choose to take requests that match what they offer, and then contact the customer. We are not a party to any agreement or payment between a customer and a business. We are not a landlord, seller, lender, insurer, school, internet provider or contractor, and we do not guarantee any quote, price, outcome, approval or quality. Please also read our Disclaimer.
3. Accounts
- You must be at least 18 years old and able to enter a binding contract.
- You register with a Kenyan mobile number, a password and a one-time code sent by SMS. Give accurate information and keep it up to date.
- One person, one account. The number you register must be yours.
- Keep your password and SMS codes private. You are responsible for activity on your account. Tell us at once if you think someone else has used it.
- We may sign you out after a period of inactivity and may lock your account after repeated wrong passwords, to keep it safe.
4. Customers
- Requests are free. We do not charge customers to make a request.
- Give true, clear details. Do not put phone numbers, emails, links or other contact details in request forms or notes. Your contact details are shared only with the business that takes your request.
- You choose how the business should contact you (phone call, SMS or WhatsApp) and by agreeing to a request you allow that one business to contact you that way about that request.
- To prevent spam we limit you to one request per category every 7 days and up to 5 open requests. Requests that no business takes expire after 14 days. You may edit or cancel a request until a business takes it.
- If a business has not contacted you within 24 hours of taking your request, you may tell us. We review each case and may return the request to the market. We cannot force a business to contact you or to give you any particular offer.
- Any deal you make is between you and the business. Check prices, terms and the business itself before you pay.
5. Points, trust score and payouts
- When a business finishes with your request it rates it from 1 to 10. You earn that many points. 1 point is worth KSh 1.
- Your trust score compares the points you have been given with the most you could have been given. It is shown after 3 rated requests and businesses can see it as Low, Medium or High.
- You may redeem points from 100 points, up to 1,000 points per redemption, with one redemption waiting at a time. Redemptions are reviewed and approved by us, then paid by M-Pesa to your verified number. You receive the full amount.
- Points have no value except to be redeemed as described. They cannot be sold, transferred or exchanged. They are lost if your account is closed or deleted.
- We may refuse, reverse or cancel points and payouts that come from fake, duplicate or abusive requests, or from any breach of these terms.
6. Businesses
- Registration is free. We verify businesses manually, and we may ask for your registration certificate, ID and, for lenders, a valid Central Bank of Kenya licence. We may approve, refuse or remove any business at our discretion.
- You pay KSh 25 for each request you take, deducted from your prepaid credit. You top up by M-Pesa (KSh 500, 1,500, 2,500, 5,000 or 10,000 packages). Prices may change with notice on the website.
- The first business to take a request receives it, and the request is removed from the market. Only that business sees the customer’s contact details and may use them only to respond to that request.
- You must contact the customer within 24 hours, using the method they chose, and be honest and professional.
- If a customer reports that you did not contact them and we confirm it, the request returns to the market and your KSh 25 is not refunded. If you report a customer as unreachable, fake or a duplicate and we confirm it, your KSh 25 is returned to your credit.
- You must rate every request you take from 1 to 10, honestly. You may hold at most 5 unrated requests at a time, and you must rate before you can take more. We may rate dormant requests on your behalf after 30 days.
- Unused credit is not refundable except where we decide otherwise or the law requires.
- Businesses offering loans must hold all licences the law requires, and must disclose the full cost of credit to customers.
7. Agents
- Agents refer customers only, using their personal link or posters. Joining is free and subject to our manual approval.
- An agent earns up to KSh 5 for each genuine request from a customer they referred, once the business that took it has rated it. The amount depends on the quality of the lead: KSh 5 multiplied by the rating out of 10. ZangCash keeps the rest. If a request earns no rating or is found to be fake, duplicate or abusive, nothing is earned.
- Withdrawals start at KSh 100. Withholding tax at 10% is deducted as required by law. Each withdrawal is approved by us and paid by M-Pesa to the agent’s verified number.
- You may not refer yourself, create fake or repeated requests, or mislead people about ZangCash. We may withhold earnings and close accounts that do.
8. Acceptable use
You must not: give false information; send fake, duplicate or abusive requests; harass or threaten anyone; ask for or offer anything illegal; try to avoid our fees or rules; copy or scrape the Service; interfere with its security; or use it to send spam. We may remove content and suspend or close accounts that break these rules.
9. Loans, insurance and other regulated services
ZangCash is not a lender, insurer or financial adviser. Loans are offered only by independent lenders that we have approved, which must hold the licences Kenyan law requires (for digital credit, a licence from the Central Bank of Kenya). Being listed does not mean we recommend or guarantee a lender. Read all costs and terms carefully before you accept any loan, and never pay a fee to receive a loan before you are given it.
10. Ratings and reviews
Customers can rate the businesses that took their requests, and businesses rate requests. Ratings must be honest and must not contain contact details, abuse or personal information. We may remove ratings that break these terms.
11. Payments
Payments to and from ZangCash are made by M-Pesa. You are responsible for any fees your mobile network charges. We may delay or refuse a payment we reasonably suspect to be fraudulent or in breach of these terms, or where the law requires.
12. Our content
The ZangCash name, logo, design and website content belong to ZangCash Pay Ltd or its licensors. You may use the Service for its intended purpose only. You keep ownership of what you submit, and you give us permission to use it to run and improve the Service.
13. Suspension and ending your account
You may close your account at any time from My account (see our Privacy Policy). We may suspend or close an account if you break these terms, if we suspect fraud or misuse, or if the law requires. Sections that by their nature should continue (for example payments already made, limits on liability and governing law) continue after your account ends.
14. Limits on our responsibility
The Service is provided “as is” and as available. To the fullest extent the law allows, ZangCash is not liable for the acts, omissions, quotes, goods or services of businesses or customers, for any loss from dealings between users, or for indirect or consequential loss, loss of profit or loss of data. Nothing in these terms limits liability that cannot lawfully be limited, including for fraud, or limits rights you have under Kenyan consumer protection law.
15. Changes to these terms
We may update these terms. We will post the new version here with a new date and, for material changes, tell you in the portal. If you keep using the Service after the change you accept it. If you do not agree, you may close your account.
16. Governing law and disputes
These terms are governed by the laws of Kenya. Please contact us first and we will try to resolve any complaint fairly. If we cannot, the courts of Kenya have jurisdiction.
